El presente artículo propone un análisis sobre el derecho a la libertad de expresión de jueces y magistrados desde la perspectiva de los estándares de derechos huma­nos en el ámbito regional e internacional, a través de la normativa y la práctica jurisprudencial al respecto. El trabajo pretende arrojar luz sobre las posibles res­tricciones a las que se podrían ver sometidos en este ámbito los miembros de la ju­dicatura con motivo del especial contenido de las funciones que desarrollan. En este artículo se presenta una propuesta formativa utilizando el cine como material cultural y fuente de conocimiento. Una película como Babel permite trabajar la globalización y la educación de la ciudadanía, con planteamientos que exigen un nuevo humanismo, una nueva relación interpersonal, conscientes de los problemas de comunicación, prejuicios y choques culturales derivados del desarrollo tecnológico. La película cuestiona esta existencia en un mundo global interrelacionado, evocando el viejo mito bíblico de la Torre de Babel haciendo énfasis en identificaciones (...) erróneas, malentendidos y oportunidades fallidas, como manos invisibles que nos guían; o el fin cuyo destino se nos escapa.Babel hace comprender la realidad de la globalización. Nos permite observar cuatro lugares tan distantes como Estados Unidos, Méjico, Marruecos y Japón, no sólo distanciados físicamente. Los cuatro países representan estilos culturales diferentes, tres formas de realización humana. Asistimos al choque, a la incomunicación personal, al aislamiento por la diferencia de cultura y la ficticia proximidad tecnológica. Vivimos juntos, pero aislados los unos de los otros. (shrink)

In this paper I argue against Simion’s (2018) Epistemic Limiting Procedure for conceptual engineering and put forward a more permissive alternative, according to which epistemic losses do not systematically block amelioration, but merely provide reasons against it. On this less restrictive view, epistemic losses will be permissible, provided that they are compensated by the non-epistemic gains of the amelioration. After fleshing out the details of my proposal, I discuss two case studies in relation to which Simion’s restrictive procedure seems to (...) yield the wrong predictions. Although most consumers are positive about socially responsible companies, in order to benefit from CSR efforts, effective and clear CSR communication is important. However, due to the constantly rising profusion of eco-labels, based on either own claims from the organization or claims made by an external third party, consumers may encounter difficulties in identifying truly responsible firms, which could result in less effective CSR initiatives, even for those responsible firms. Therefore, building on attribution theory, this study seeks to identify how (...) uncertified internal CSR claims and external third-party CSR labels should be used in order to deter greenwashing and increase positive consumer evaluations. Within a 3 × 2 design, respondents are exposed to different coffee product packages measuring their attitude toward the brand, corporate credibility, purchase intention, and scent perception, as well as perceived attributional CSR motives. Overall, findings indicate that especially an external CSR label affects consumer responses toward the firm. Moreover, perceived CSR motives serve as a mediator between an external CSR label and corporate credibility and brand attitude, respectively. These findings warrant further consideration of introducing an external multilevel rating systems by governmental law. (shrink)

Nursing policy and healthcare reform are focusing on two, interconnected areas: person‐centred care and fundamental care. Each initiative emphasises a positive nurse–patient relationship. For these initiatives to work, nurses require guidance for how they can best develop and maintain relationships with their patients in practice. Although empirical evidence on the nurse–patient relationship is increasing, findings derived from this research are not readily or easily transferable to the complexities and diversities of nursing practice. This study describes a novel methodological approach, called (...) holistic interpretive synthesis (HIS), for interpreting empirical research findings to create practice‐relevant recommendations for nurses. Using HIS, umbrella review findings on the nurse–patient relationship are interpreted through the lens of the Fundamentals of Care Framework. The recommendations for the nurse–patient relationship created through this approach can be used by nurses to establish, maintain and evaluate therapeutic relationships with patients to deliver person‐centred fundamental care. Future research should evaluate the validity and impact of these recommendations and test the feasibility of using HIS for other areas of nursing practice and further refine the approach. (shrink)

The use in psychology of crowdsourcing platforms as a method of data collection has been increasing in popularity because of its relative ease and versatility. Our goal is to adapt the Gratitude Questionnaire–20 Items to the English language by using data collected through a crowdsourcing platform. The G20 is a comprehensive instrument that takes in consideration the different basic processes of gratitude and assesses the construct’s cognitive, evaluative, emotional, and behavioral processes. We test the psychometric properties of the English version (...) of the G20 with a Prolific user sample. We assess the adequacy of the G20 for the crowdsourcing population in its English version. A description of the characteristics of the participants is conducted. Reliability analyses reveal an optimal internal consistency of the adapted scale. The results are discussed from a cross-cultural vision of gratitude. We conclude that the Gratitude Questionnaire–20 Items, adapted to English with an American sample, is a psychometrically strong instrument to measure gratitude using crowdsourcing platforms for data collection and, therefore, a reference and useful tool in future research. The aim of this paper is twofold. Firstly, it analyses the similarities that stem from Wittgenstein’s (Philosophical Investigations (1953)) and Brandom’s (Making it Explicit (1994)) commitment to pragmatics in the philosophy of language to account for moral utterances. That is, the study of the meaning of moral utterances is carried out resorting to the study of the acts being performed in producing or exhibiting these utterances. Both authors offer, therefore, a pragmatic solution in order to account for the meaning of (...) our moral vocabulary and discursive practices. Secondly, it argues that both approaches lead to differing understandings of the role of “truth” and “falsity” in moral discourse. On the one hand, Wittgenstein’s remarks on ethics demonstrate a dismissive attitude towards the notions of truth and falsity in moral discourse. On the other hand, Brandom seems to be committed to a weak version of moral cognitivism: he takes assertions (which express beliefs, i.e. doxastic commitments) as the fundamental linguistic activity in the game of giving and asking for reasons and provides an anaphoric theory of truth to account for “truth” and “falsity” in our discourse. Additionally, it analyses how these differences bear on the Frege–Geach problem. (shrink)

Research on individual differences in facing the COVID-19 pandemic seems to be crucial in order to design diverse and highly effective intervention strategies. This study uses a sample of 302 North American participants who were recruited through the crowdsourcing platform ProA; different profiles were established, profiling variables of interest in facing the COVID-19 outbreak. Socio-demographic and psychological (personality traits, gratitude, life purpose, and religiosity) variables were explored. The Fundamentals of Care Framework is an evidence‐based, theory‐informed framework that conceptualises high‐quality fundamental care. The Framework places the nurse–patient relationship at the centre of care provision and outlines the nurse behaviours required for relationship development. Numerous instruments exist to measure behavioural aspects of the nurse–patient relationship; however, the literature offers little guidance on which instruments are psychometrically sound and best measure the core relationship elements of the Fundamentals of Care Framework. This study evaluated the quality of nurse–patient relationship instruments (...) by (1) assessing their content development and measurement properties (e.g. dimensionality, targeting, reliability, validity) and (2) mapping instrument content to the Framework's core relationship elements: trust, focus, anticipate, know, and evaluate. Twenty‐seven instruments were evaluated. Findings demonstrated that patients and nurses were rarely involved in item development. Most instruments exhibited poor measurement properties, with only one instrument having complete information on all quality indicators. Instrument content focused primarily on nurses getting to know patients and earning their trust, with only 54, 18, and 1 item(s), respectively, measuring ‘focus’, ‘anticipate’ and ‘evaluate’. Hence, there does not appear to be a robust instrument measuring behavioural aspects of nurse–patient relationships, nor one capturing the relationship elements of the Fundamentals of Care Framework. Summary This paper aims to bridge anthropological and cognitivist research undertaken by Gilbert Durand and Mark Johnson, who studied the phenomenon of meaning making in a similar way, although they had to use different terminology as their disciplines demanded. Durand established systematization for analyzing symbolism by taking into account the position of the body and the perceptions determining the underlying schemata of symbols. Two decades later, Mark Johnson described image schemata as gestalts having an internal structure derived from bodily perceptions. (...) Owing to these similarities, a comparison between Durand and Johnson’s theories is offered first. In the second place, I reviewed the cognitive value of the anthropological regimes of imaginaire described by Durand. During the analysis, the terminology used by these theorists (like ‘image schemata’ or ‘axiomatic schemata’) was comparatively analyzed to find common ground between their positions. In conclusion, the need for recovering theories of imagination proposed by heterodox scholars like Durand is highlighted, since they anticipate the role of images and imagination not only in language, as Johnson demonstrated, but also in the formation of anthropologically relevant symbols, which are of interest for the analysis of literature and other arts. Algunas formulaciones de la filosofía política reciente han descuidado el carácter históricamente indexado de conceptos como libertad política, propiedad o soberanía, propiciando un uso anacrónico e impreciso de su significado. No obstante, su posición académica y social dominante informa el «sentido común» filosófico- político de nuestra época. Locke constituye un ejemplo de cómo la coyuntura interpretativa liberal, que se desplegó en el siglo XIX y se consolidó en el XX, ha oscurecido una parte de la complejidad y pluralidad de las (...) tradiciones intelectuales y normativas que heredó. La reconstrucción de la filosofía política lockeana a partir de su concepción fiduciaria de la libertad política contribuye a hacer de nuevo visible el significado de algunas concepciones fundamentales para la teorización normativa presente. In this paper, I propose an account of self-knowledge for desires. According to this account, we form beliefs about our own desires on the basis of our grounds for those desires. First, I distinguish several types of desires and their corresponding grounds. Next, I make the case that we usually believe that we have a certain desire on the basis of our grounds for it. Then, I argue that a belief formed thus is epistemically privileged. Finally, I compare this account (...) to two other similar accounts of self-knowledge. (shrink)

Projectibility has traditionally been given a prominent role in natural kind theories. However, where most of these theories take projectibility to be a necessary but insufficient feature of natural kinds, this paper defends an account of natural kinds according to which the naturalness of kinds is to be identified with their degree of projectibility only. This view follows thus the path opened by Häggqvist (2005), although it goes significantly further on two main respects. First, I develop and discuss two important (...) dimensions of projectibility that are overlooked in Häggqvist’s work. This essay offers a discussion and contextualisation of a series of letters exchanged between Jordi Cat and Paul Feyerabend from 1989 to 1994. These letters provide insights into Feyerabend’s later thought on a variety of themes including quantum holism, the disunity of science, the development of logical empiricism, and science activism. In doing so, we provide some original analysis and exegesis of Feyerabend’s evolving views on scientific methodology and quantum mechanics by focusing on Feyerabend’s changing attitudes towards Bohm, Bohr, (...) and his eventual colleague Hans Primas and his later sympathies with the algebraic approach. We also highlight Feyerabend’s role in the growth of the Disunity of Science movement and how he connected disunity to practical considerations in the philosophy of action. (shrink)

The purpose of this essay is to account for privileged access or, more precisely, the special kind of epistemic right that we have to some beliefs about our own mental states. My account will have the following two main virtues. First of all, it will only appeal to those conceptual elements that, arguably, we already use in order to account for perceptual knowledge. In this paper I examine the notion and role of metaphors and illustrations in Maxwell's works in exact science as a pathway into a broader and richer philosophical conception of a scientist and scientific practice. While some of these notions and methods are still at work in current scientific research-from economics and biology to quantum computation and quantum field theory-, here I have chosen to attest to their entrenchment and complexity in actual science by attempting to make some conceptual sense (...) of Maxwell's own usage; this endeavour includes situating Maxwell's conceptions and applications in his own culture of Victorian science and philosophy. I trace Maxwell's notions to the formulation of the problem of understanding, or interpreting, abstract representations such as potential functions and Lagrangian equations. I articulate the solution in terms of abstract-concrete relations, where the concrete, in tune with Victorian British psychology and engineering, includes the muscular as well as the pictorial. This sets the basis for a conception of understanding in terms of unification and concrete modelling, or representation. I examine the relation of illustration to analogies and metaphors on which this account rests. Lastly, I stress and explain the importance of context-dependence, its consequences for realism-instrumentalism debates, and Maxwell's own emphasis on method. (shrink)

The Transcendental Reading of the Tractatus argues that Wittgenstein endorses, under the notion of ‘metaphysical subject’, the existence of a willing subject as a transcendental condition of ethics and representation. Tejedor aims to reject this reading resorting to three criticisms. The notion of ‘willing subject’ does not appear explicitly in, nor can it be deduced from, the Tractatus, the metaphysical subject and the willing subject are not synonymous or analogous notions and, finally, Wittgenstein abandons the notion of ‘willing subject’ at (...) the end of the Notebooks. The aim of this article is twofold. Firstly, it analyzes the critique introduced by Tejedor and presents three problems that demonstrate that Tejedor’s critique cannot adequately reject the Transcendental Reading. Secondly, it sets forth an alternative reading of the Tractatus that overcomes the issues that stem from the Transcendental Reading. This alternative reading conceives the metaphysical subject as an ethical subject and a willing subject. Additionally, it advances an alternative account of the transcendental character of ethics that does not defend the existence of a transcendental subject understood as a condition of ethics and representation in the Tractatus. The aims of this study were to analyze the peak physical demands in elite futsal by quantifying the most demanding scenarios of match play and to identify the differences between playing positions and the seasonal trend for five different rolling average time windows. The most demanding scenarios of external load from distance, speed, acceleration, and deceleration variables were obtained from 14 elite futsal players using a local positioning system during 15 official matches in the premier Spanish Futsal League. The results (...) showed an extremely large effect of the time window for all dependent variables in all positional groups. Another important finding of this study was that, in regard to the seasonal trend, only defenders reported clear moderate-large positive trends for high-speed running efforts, high-acceleration efforts, and high-deceleration efforts. Finally, moderate-large individual differences in player means for all dependent variables and clear differences between games for most dependent variables were found, suggesting how likely contextual factors may exert an influence on how “demanding” the most demanding scenarios are. The findings of this study provide coaches and strength and conditioning coaches further knowledge of the peak physical demands in elite futsal competition. This valuable information may lead to a more precise position-specific training prescription. (shrink)

In such a way, by means of (...) a demonstration that is defined in comparative terms, the man can end up understanding superior entities to his intellect -such as the divine one-, because a correspondence settles down among same elements. La evidencia empírica disponible señala de manera unánime que las nuevas políticas de tráfico y seguridad vial aplicadas en España desde 2004, y en particular la introducción del carné por puntos y la reforma del Código Penal, han tenido una fuerte incidencia positiva en la reducción de la siniestralidad. De dichos resultados se deriva que las nuevas políticas han tenido también un efecto positivo sobre la conducta de los conductores, de modo que ha sido esa mejora en la conducta al (...) volante la que finalmente se ha traducido en una reducción de la siniestralidad. No obstante, hasta el momento, los investigadores han descuidado el análisis directo de los datos sobre cumplimiento. En el presente trabajo se analizan todos los datos disponibles que ofrecen información sobre el cumplimiento de la normativa de tráfico y seguridad vial. (shrink)
